Version 2026-09-30. These terms apply to the ShowTrack subscription service when accepted during signup.
These terms apply to the ShowTrack subscription service. “Customer” means the individual or business on whose behalf a ShowTrack account is created.
Customer retains its rights in data that Customer or its authorized users enter into ShowTrack. ShowTrack will use reasonable measures to protect that data. If data is lost or corrupted, ShowTrack will use commercially reasonable efforts to investigate and restore affected data from any usable backups it maintains. ShowTrack does not guarantee uninterrupted access to the service or recovery of every record.
Images captured during QR code scans are kept, if at all, only as a convenience. ShowTrack may not keep copies of these images, may delete historical scan images from time to time, and does not guarantee that any scan image will remain available. Scan images are not included in the self-service customer records download. Customer should keep its own copies of any images it needs.
Customer is responsible for keeping independent copies of important source records and exported information. The self-service customer records download contains selected, currently retained account records; it is not a complete backup of every record or file held by ShowTrack. Applicable legal rights to access personal information are unaffected.
ShowTrack is a business tracking tool, not an accounting system that guarantees exact reconciliation to the penny. Some sales, fee, net proceeds, cost, and profit figures are estimates or allocations based on information entered by Customer, imported from Whatnot, and calculated using the settings selected in ShowTrack.
Figures in ShowTrack may differ from Whatnot’s final statements or payouts and from Customer’s accounting records. Differences may result from rounding, incomplete or later-changed source data, post-show cancellations or refunds, fee adjustments, or amounts Whatnot charges or recoups in a later show or payout. Customer is responsible for reviewing and reconciling material figures against Whatnot’s records and its own records before relying on them for accounting, tax reporting, or other business decisions.
To the fullest extent permitted by applicable law, ShowTrack will not be liable for lost profits, lost sales, business interruption, or other indirect or consequential damages arising from use of the service or from loss, corruption, or unavailability of customer data.
To the fullest extent permitted by applicable law, ShowTrack’s total liability for all claims arising out of or relating to the service will not exceed the subscription fees Customer paid to ShowTrack during the 12 months before the event giving rise to the claim. If those fees total less than $50, the liability limit is $50.
To the extent state law governs, Texas law governs these Terms and any claim arising out of or relating to these Terms or the service, regardless of legal theory and without regard to conflict-of-law rules, except where applicable law requires otherwise.
Any lawsuit arising out of or relating to these Terms or the service must be brought exclusively in the state courts located in Dallas County, Texas, or, if federal jurisdiction exists, the U.S. District Court for the Northern District of Texas, Dallas Division. Each party consents to the personal jurisdiction of those courts.
